1. In these Terms and Conditions we and us mean Urban Brats and you mean you the customer. These Terms and Conditions together with your Order constitute the entire Contract between Urban Brats and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.
2. This entire website, copy, logos, text, images, content, and exclusive method of showcasing products is copyright 2009 urbanbrats.com.au All trademarks appearing herein are acknowledged. Permission to use documents delivered from this World Wide Web site and or server and related graphics is restricted. The name of urbanbrats.com.au, Urban Brats or any of the above trademarks or logos may not be used in advertising or publicity pertaining to distribution of this information without specific, written prior permission. The information contained in this website is subject to change without notice. We are not responsible for typographical, technical, or descriptive errors of products herein.

Whilst Urban Brats makes every reasonable attempt to present accurate information on this web site, the information may contain typographical faults or inaccuracies and may not be complete or current. 4. We have done our best to display as precisely as possible the colours of the products shown on this web site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitors display of any colour will be accurate.
5. We only sell and ship Products within Australia. We will not make deliveries outside of Australia at this stage. However if you contact info@urbanbrats.com.au special arrangements can be organised.
6. You may place an Order by totalling items to Shopping Cart on Urban Brats Web Site and clicking the Check Out button. When you place your Order, we will issue you with an Order Number. We will do this by email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. We will notify you that your order is being processed by sending you an Order Confirmation via email. Urban Brats and its associates keep the right to refuse service, remove or amend content, or cancel orders in their sole discretion. No information on our website constitutes or should be deemed as an offer by us to supply any Products; however Urban Brats will make every endeavour to supply Products to you. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.
7. Transactions are processed via PayPal. As a PayPal user, you are protected from any payment that you did not authorise. When you purchase goods online with PayPal, your transactions are covered by the Buyer Complaint Policy. If PayPal find the complaint in your favour, the amount of the payment, if available from the seller, will be transferred back to your account. 8. All Urban Brats purchases include GST unless otherwise stated on the Product listing.
9. Urban Brats will use its best endeavour to list Products with the most competitive prices. Urban Brats reserves the right to change prices for Products displayed at the Urban Brats web site at any time.
10. Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. When your ordered items have been dispatched, we will email you to verify shipment of each item.
11. Delivery of your purchase is by Australia Post. We will deliver your Products to the address indicated on your Order Confirmation. If no one is available to take delivery of your products, our carrier (Australia Post) will leave a card so you can pick up your product from your local Post Office. We will use our reasonable efforts to deliver your products to you within the 14-21 days however, we do not guarantee that we will deliver within this time frame. There is free shipping for all orders over $150 within Australia.
12. Only credits are offered if you have changed your mind about the product, made an incorrect choice, or failed to verify and accurately provide information when placing an order.
13. You may be entitled to a credit, provided you return the item to us within 14 days of receipt of goods. The item must be returned to us in brand new condition, with the packaging and item being exactly as it was when you received it. This includes the return of the original packaging including labels and tags still being attached. If the returned item is in a noticeably used condition, then a credit may not be offered. Clothing and footwear items may not be returned if they have been worn, or if sewing tags have been removed. Return postage is at your expense. We will issue you a Credit Voucher to the value of the item, once the item is returned. Credit allows you to purchase something different all together, after having viewed your original purchase. Once we have received your returned item or the refund has been approved according to your issue, we will then send you either notification of receipt of your item and/or an email issuing you a credit Refund. A credit of the purchase price will be emailed to you. Which you can then use on a future purchases. You must also notify us within 14 calendar days from the date of your product being dispatched from our warehouse of any damage or faults. After this time period your products normal warranty applies. If you have received an item that is damaged please contact us at customerservice@urbanbrats.com.au and advise us of the nature and extent of the damage. Please also advise us of your name, contact number and order number.
14. Some Products sold through Urban Brats are serviced and supported exclusively by their manufacturer in accordance the warranty information provided on the listing. For items advertised and sold with manufacturers warranty, we would ask you to contact the manufacturer or supplier in the first instance for replacement or repair under the warranty terms. If the manufacturer is unable to comply, Urban Brats will refund you the purchase price for that item.
15. We will refund any items damaged in transit, at our cost, just as soon as we receive the damaged item back. We apologise for any inconvenience.
16. Urban Brats respects your privacy and guarantee to maintain and use your personal information provided to us responsibly. We do not rent, sell, share or provide this information to any other source. Your personal information and order history are available to you and only you. We will only send you product updates, news and promotional offers if you have opted to receive newsletters from us.
17. Urban Brats will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
